Records and questions

What to ask for, and what the documents support

The documents set out how the contract renews, how the City can end it, and where records requests for City Records go. The items below are questions and records requests the documents support. None of them presumes an outcome. Renewal is the default: unless someone gives written notice at least 30 days before a term ends, the contract renews.[T&C §7.1]

Ground rules

Everything on this page is ordinary records and public-information activity: asking the City and the Police Department questions, asking for records, and checking the documents yourself. Do not contact anyone at home, and do not harass anyone. Do not touch or move the cameras; the vendor terms say Flock owns the hardware and the City may not alter it.[T&C §10.1] Named officials appear here only in the roles they signed in.

The dates the documents set

What can and cannot be dated

The Order Form sets a 60-month initial term and a 24-month renewal term.[OF p.13] Under the vendor terms, the contract renews automatically unless either side gives notice of non-renewal at least 30 days before the current term ends.[T&C §7.1] Flock must give 60 days' notice before the end of a term of any fee change, and a fee change applies only to later renewal terms.[T&C §6.2]

The term begins at first installation of Flock Hardware.[T&C §7.1] The documents do not give an installation date. Without it, they cannot date the end of the first term or the non-renewal notice deadline. Once the installation date is known, the end of the 60-month term and the notice deadline 30 days before it can be counted from it.

The short list

Five things to ask for or check

Each item names the document that supports it. Where the documents are silent, the item says so.

  1. 1. Request City Records City Records are subject to the Colorado Open Records Act, and Flock must tell the City about any CORA request it receives for City Records and refer the requester to the City.[ADD p.1] A request for City Records therefore goes to the City, not to Flock. The document set does not describe the City's request process or give a request form. 15 minutes
  2. 2. Ask for the renewal dates and the City's plan Ask the City when the first term started, when the current term ends, and whether the City plans to give non-renewal notice before the 30-day deadline. Written notices under the Addendum go to the City Clerk.[T&C §7.1][ADD p.1] 10 minutes
  3. 3. Ask whether the $15,000 a year is appropriated The City does not create multi-year debt, and payment obligations after the current fiscal year depend on funds being appropriated. Fiscal years end December 31. If the City does not appropriate the funds, the Agreement terminates automatically. The City may also end it for non-appropriation on 30 days' written notice, without penalty or other cost. Ask whether the current year's payment has been appropriated.[ADD p.3][T&C §11.15] 10 minutes
  4. 4. Ask for the audits and a retention reconciliation Policy 422.5(e) says “ALPR system audits should be conducted on a regular basis.” Ask the Police Department for its audit reports or its audit schedule, and who receives them. The document set contains no audit reports and gives no schedule.[POL 422.5(e)] Also ask the department to state in writing how the 30-day retention in the Order Form and the portal fits with the statement in Policy 422.4 that server data “should be securely stored for 1 year.”[OF p.13][PORTAL][POL 422.4] One letter
  5. 5. Ask who can search the City's data The Order Form lists Direct Share, hotlist alerts, and statewide and nationwide lookup networks. Ask whether each is turned on for Edgewater's account, and who can use it. The portal lists about 90 external agencies with access. Policy 422.5(d) allows release to other verified agencies “at any time for legitimate law enforcement purposes.” Ask whether the portal's list is current.[OF p.17][PORTAL][POL 422.5(d)] 15 minutes

Where requests go

The addresses in the documents

The one City address in the document set is the Addendum's notice address for written notices to the City: Lenore Pedroza, City Clerk, 1800 Harlan Street, Suite C, Edgewater, Colorado 80214.[ADD p.1] Flock's notices go to its Legal Department in Atlanta.[ADD p.1]

The document set includes no phone number or email address for the City or the Police Department, and this site does not supply one. For questions about this site, see the FAQ.

What the document set does not include

No council minutes or vote approving the contract, no installation dates or camera locations, no records-request responses, no audit reports, and no news or community reporting. Where an item above depends on one of these, it says so rather than filling the gap.

A specific question tied to a clause or a page is easier to answer than a general objection. The documents are summarized, with their pages tagged, on the pages below.
